Welcome to Georgian Resorts.
These Terms and Conditions (hereinafter referred to as the “Terms”) regulate the legal relationship between the user of the website/platform and the individual entrepreneur Nodar Kozanashvili (Identification Number: 11001032038) (hereinafter referred to as “we”, “us”, “Georgian Resorts”).
Please read these Terms carefully. Use of our Platform, registration, or booking of any service constitutes your agreement to and acceptance of this document.
1. General Provisions and Definitions
1.1. In these Terms and Conditions (hereinafter referred to as the “Terms”), unless the context clearly requires otherwise, the following terms shall have the meanings set forth below:
- Company / Administrator: Individual entrepreneur Nodar Kozanashvili (Identification Number: 11001032038), who is the owner of the website/platform and the person responsible for its administration and management.
- Platform / Website: The online environment operated by the Company (georgianresorts.ge and related mobile applications), where services are published and bookings are made.
- User / Client: A natural or legal person who is registered on the Platform and carries out the search for, ordering, and/or purchase of services.
- Account / Profile: The User’s unique personal page on the Platform, created as a result of registration and protected by a password.
- Service Provider / Partner: A third party (natural or legal person) who is directly responsible for the provision, quality, and safety of the booked service (including but not limited to hotels, instructors, tour guides, etc.).
- Distance Contract: The booking and purchase of services carried out exclusively through the online Platform, without the simultaneous physical presence of the parties.
- Intermediary (Agent): The role of the Company, which involves connecting the User and the Service Provider and ensuring the technical execution of the transaction. The Company is not the direct provider or performer of the service.
- Service: Any product or offer published on the Platform and available for booking, including but not limited to hotels, restaurants, tours, children’s activities, equipment, and other services.
- Sports / Adventure Service: A special category of services involving physical activity and increased risk, (skiing, snowboarding, jeep tours, snowmobile tours, equipment rental).
- Instructor / Guide: A person designated by the Service Provider who ensures the direct provision of the adventure service.
- Booking / Reservation: The process by which the User purchases or reserves a service through the Platform, which entails a financial obligation.
- Payment System: A technical system intended for cashless transactions, ensuring the security of payments and transactions.
- Fee / Tariff: The price of the service, which includes the Service Provider’s fee and the Platform’s service commission; however, payment is made separately.
- Cancellation / Modification: The cancellation of a booking or modification of its details, which is regulated by a separate “Cancellation and Refund Policy.”
- Force Majeure: An irresistible force or unforeseen event that prevents or delays the performance of the service, including but not limited to natural disasters, cable car shutdowns, or road closures.
- Privacy Policy: A separate document describing how the Company collects, stores, and processes the User’s personal data.
2. Description of Services and the Role of the Platform
2.1.
Georgian Resorts is a digital space that offers users a wide range of services related to ski resorts and other resorts in Georgia. These services include, but are not limited to:
Adventure/Sports Services: rental of sports equipment, booking of ski/snowboard instructors.
Tours and Logistics: organization/booking of guided snowmobile, jeep, or other types of transportation tours.
Accommodation and Dining: booking of hotels and restaurants.
Special Activities: purchase of children’s activities and other additional local services.
2.2. Role of the Company – Intermediation:
- Georgian Resorts acts exclusively in the capacity of an intermediary (agent). Our primary function is to connect the user with the direct service provider/partner and to ensure the technical proper functioning of the booking and payment process.
- The Company is not the direct provider, performer, or operator of the service (except in cases where this is explicitly indicated in the description of a specific service).
2.3. Limitation (Separation) of Liability:
- The Platform is responsible solely for the proper functioning of the Platform (website/application), accurate recording of bookings, and ensuring payment security.
- The Partner/Service Provider is solely responsible for:
- the quality, safety, and timely performance of the booked service;
- the qualifications and engagement of the instructor/guide;
- the proper condition and compliance of the equipment/gear;
- the compliance of the hotel room or restaurant service with the description published on the website.
2.4.
We/The Platform are responsible for the accuracy of the information placed on the Platform by the service provider, as no information may be published without our approval. However, in the event of any inaccuracy, you are entitled to contact us, and we will ensure the elimination of the relevant issue.
2.5.
At the moment the user books a service, the contract enters into force directly between the user and the service provider, the terms of which are governed by these Terms and Conditions and the additional rules of the service provider.
3. Registration and Account Security
3.1.
In order to fully receive the services, registration on the Platform is required.
3.2.
The user is obliged to provide truthful and accurate information (first name, last name, contact number, email address).
3.3.
The user is responsible for maintaining the confidentiality of their account credentials (password).
4. Conclusion of a Distance Contract and Provision of Information
4.1.
Booking any service through the Platform constitutes the conclusion of a distance contract between the user and the service provider.
4.2.
Prior to the final confirmation of each booking, the user shall be provided with full and comprehensive information, including:
a. the Company’s legal details (as an intermediary), contact address, and email address;
b. the legal name, actual address, and contact details of the service provider/partner;
c. the main characteristics of the service, its total fee/tariff, and the payment procedure;
d. the existence or absence of the right to withdraw from the distance contract and the conditions for exercising such right.
4.3.
The user is obliged to confirm that they have read and agree to these Terms and Conditions and the specific rules of the service provider prior to clicking the booking button.
5. Booking and Payment Procedure
5.1.
When making a booking on the Platform, you enter into a contract directly with the service provider, and Georgian Resorts acts as an agent.
5.2.
All prices are indicated in the national currency (GEL) and include taxes provided by law, unless otherwise specified.
5.3.
Payment is made cashlessly, through our partner Bank of Georgia’s secure system.
5.4.
A booking is considered confirmed only upon receipt of the corresponding confirmation message (email/SMS).
6. Right of Withdrawal from the Contract
6.1.
The user has the right to withdraw from the distance contract without giving any reason within fourteen (14) calendar days. The period starts counting from the conclusion of the contract in the case of services.
6.2.
The user does not have the right to withdraw from the contract within the 14-day period if the service includes:
a. Accommodation services (hotels) for residential purposes;
b. Transportation services (tours, jeeps, snowmobiles);
c. Leisure or entertainment services (children’s activities, sports/adventure services), if the contract provides for the performance on a specific date or period.
6.3.
Since the majority of services purchased through our Platform are strictly time-bound (accommodation, tours), the 14-day right of withdrawal under clause 6.1 generally does not apply and is regulated by the specific cancellation policy of the service provider.
6.4.
In cases where the 14-day right of withdrawal applies, the user must resolve the matter of the refund directly with the service provider, since we do not provide the service ourselves, nor is payment for such service made to us.
7. Booking, Cancellation, and Refunds
7.1.
When making a booking on the Platform, the user assumes a financial obligation and enters into a distance contract directly with the service provider.
7.2.
Each service (hotel, tour, instructor, etc.) may have individual cancellation terms, which are specified on the respective service page.
7.3. General Rule:
- Cancellation by the User: If the user cancels a booking and no longer wishes to receive the service, and has paid in advance, the booking commission is non-refundable. The matter of refunding the full or partial prepayment (if any) is to be settled between the user and the service provider.
- Force Majeure: In case of service cancellation due to adverse weather conditions (cable car shutdown, avalanche risk), Georgian Resorts will ensure the process of refunding the booking amount or offer an alternative date/time.
Limitation of Liability
8.1. Awareness of Risks:
The user acknowledges that certain services (skiing/snowboarding, snowmobile rides, jeep tours) involve physical risk. By purchasing these services, the user assumes responsibility for their own health and safety.
8.2. Georgian Resorts is not liable for:
- Physical injuries or damages incurred while receiving the service;
- The personal actions of instructors or guides;
- Tours canceled due to weather conditions;
- Damage to equipment by the user (in which case the user bears material responsibility).
8.3.
Our Platform does not guarantee the 100% accuracy of information provided by service providers (photos, descriptions). In the event of any inaccuracy, the user is entitled to notify us, and we will review and attempt to resolve the matter.
9. Rules of Conduct and Safety
9.1. The user is obliged to:
- Follow the instructions of the instructor/guide;
- Not be under the influence of alcohol or drugs during extreme activities;
- Use appropriate equipment (helmet and other protective gear).
9.2.
In the event of a violation of these rules, the service provider has the right to discontinue the provision of the service to the user without refund.
10. Intellectual Property
10.1.
The design of the website, logo, texts, and software constitute the property of Georgian Resorts and are protected by copyright.
10.2.
It is prohibited to use Platform materials for commercial purposes without written permission.
11. Privacy and Personal Data
11.1.
We collect and process your personal data in accordance with the “Personal Data Protection Policy” and the law, in order to ensure the provision of services.
11.2.
Your data (name, phone number) is provided only to the partner (e.g., instructor) whose service you are booking.
12. Applicable Law and Dispute Resolution
12.1.
These Terms and Conditions are governed by the legislation of Georgia.
12.2.
The user has the right to submit a claim to the Company regarding any identified deficiencies or violations of rights via email [email address].
12.3.
The Company is obliged to respond to the user’s claim in writing within fourteen (14) calendar days.
12.4.
If a dispute cannot be resolved through negotiation, the user has the right to apply to the competent state authority or court.
